Nurse Practitioner Indemnity Insurance

NZMII have provided indemnity insurance cover for a wide variety of healthcare professionals in New Zealand for over 25 years, with the historical exception of nurses.

Nurse Practitioners are increasingly taking on leadership roles within the healthcare sector both in terms of delivering care as the lead provider but also in integrating with multidisciplinary teams across both primary and secondary services.

With the growing number of Nurse Practitioners alongside an expanding scope of practice it was timely that we also widened our indemnity insurance cover offering to provide an alternative option for Nurse Practitioners.

Based on our extensive experience in the medico-legal arena here in NZ we have developed an indemnity insurance policy tailored specifically for Nurse Practitioners to give you the right level of cover to protect you from any eventualities related to your practice.

What are you covered for?

The NZMII Nurse Practitioner policy will pay up to $2,000,000 per annum, subject to a limit of $1,000,000 per incident

What are your covered for?

NZMII’s Nurse Practitioner Indemnity Insurance Policy is a legally binding contract of insurance which provides Nurse Practitioners with comprehensive insurance protection.

The policy provides the following cover:

  1. Medical Malpractice Indemnity
    This will cover any costs or damages awarded against you in medical malpractice/negligence claims as well as paying for legal and other defence costs, whether the case against you is successful or not.

  2. Legal and Disciplinary Defence
    This will cover legal costs and expenses incurred in the defence of any action or enquiry brought against you such as medical discipline hearings, Committees of Enquiry, Court Martial, ACC Enquiries, Privacy Complaints Tribunal, Coroners’ Courts and the like.

  3. Loss of Earnings
    This will provide a payment of up to $1000 per day or part day (or subject to a maximum of $15,000) where you are required to attend any action or enquiry brought against you and where you have suffered loss of earnings as a result of such attendance.

The insurance will pay up to $2,000,000 per annum under the Medical Malpractice Indemnity and Legal and Disciplinary Defence Costs sections of the cover, subject to a limit of $1,000,000 per incident. Included is cover for up to $250,000 in respect of punitive and exemplary damage claims.

The insurance will also help pay up to $20,000 per annum under the Expenses Reimbursement section of the cover.

What is not covered by the plan?

Like all insurance policies, there are a number of exclusions. These are reasonable and full details are contained in the policy document. They include:

  • Any Claim in relation to the dishonest, fraudulent, criminal, malicious, deceitful, or wilful act, omission or conduct of the Insured.
  • Any claim or liability in relation to or arising out of any employment relationship problem.
  • Any liability on the part of the Insured to pay any fine, penalty or tax.
  • Any obligation to refund professional fees.
  • Any claim that breaches current medical or professional publication or best practice guideline related to the maintenance of professional boundaries (including but not limited to sexual boundaries).

These are certain obligations upon a practitioner making a claim under the policy. Most importantly, the Insured is obliged to provide NZMII with immediate written notice of any claim, or of any circumstances which could reasonably be expected to give rise to a claim.

 

Furthermore, the Insured is obliged to disclose voluntarily to NZMII all information relevant to any claim, and not to provide information which is false or misleading. In cases of non-compliance with these conditions, the Insured’s cover is likely to be compromised. In cases of serious non-compliance, cover could be declined or withdrawn.

What about your past activities?

The NZMII Nurse Practitioner indemnity insurance policy is a ‘claims made’ policy. This means that apart from current or pending claims or complaints against you, the policy will respond to any claims arising from your medical duties or functions performed by you both prior to as well as after the date you took out the insurance cover.
